Appellate Law

pa-appellate

Radey attorneys regularly serve as appellate counsel in a variety of civil appeals in both Florida and federal courts. Most of the appellate cases handled by our lawyers involve complex or commercial litigation and appeals under the Florida Administrative Procedure Act.

Our lawyers have participated as either lead counsel or co-counsel in more than 200 reported appellate opinions in state and federal courts. They have represented both private corporations and governmental entities in numerous high-profile cases. For example, Shareholder Susan F. Clark formerly served as general counsel of the Florida Public Service Commission (“PSC”) and represented her agency in more than 30 appellate cases. Ms. Clark later served on the PSC as a commissioner and served as the commission’s chairperson. Shareholders Karen Asher-Cohen and Of Counsel David A. Yon, represented the former Florida Department of Insurance (now the Office of Insurance Regulation) in a number of high-profile appellate cases relating to insurance issues. For example, Ms. Asher-Cohen co-wrote the briefs in Barnett Bank v. Nelson, 517 U.S. 25 (1996), a United States Supreme Court case relating to the sale of insurance by financial institutions, and she served as co-counsel in two significant insurance cases before the 11th U.S. Circuit Court of Appeals, Blackfeet Nat’l Bank v. Nelson, 171 F.3d 1237 (11th Cir. 1999), and Vesta Fire Insurance Corp. v. State of Florida, 141 F.3d 1427 (11th Cir. 1998).

Our lawyers have represented clients in numerous appeals involving insurance companies, hospitals, health maintenance organizations, public utilities and telecommunications companies, business associations, non-profit organizations, and other entities regulated by state government. By combining our knowledge of clients’ industries with our substantial appellate experience, Radey is able to effectively pursue appeals in both federal and state court actions.
