OIR Reminds Health Insurers About Annual Filings and PPACA Impact

The Florida Office of Insurance Regulation (OIR) has issued a notice to life and health insurance about their annual filing obligations and the impacts of the Patient Protection and Affordable Care Act (PPACA) on review timelines.

In a February 27, 2026, notice, OIR reminded all health insurers that Section 627.410(7)(a), Florida Statutes, requires them to submit at least one filing each year. The statutory obligation may be satisfied by submitting a rate filing demonstrating the reasonableness of benefits in relation to premiums or, if no change change is proposed, by submitting a certification that existing benefits remain reasonable in relation to premiums currently charged. Filings are submitted through the Insurance Regulation Filing System available (IRFS) through OIR’s website at www.floir.gov.

OIR recommended that insurers keep in mind its heavy workload during the PPACA filing season, from late May though August. The increased filing volume during this time can result in longer review periods. OIR suggested that insurers might consider deferring filings that are not time-sensitive to periods that experience fewer filings.

Finally, OIR reminded insurers that the consequences of failing to meet the annual filing requirement can be substantial. In addition to any other penalty that may apply, OIR has the authority to order a non-compliant insurer to discontinue the issuance of policies until the required filing is properly submitted.
