USDOL Requests Public Input

In a news release on 12/21/2010, the U.S. Department of Labor’s Wage and Hour Division requested public comments on its preliminary interpretations of a new provision of the Fair Labor Standards Act requiring employers provide reasonable break time and a private space for expressing breast milk while at work to nursing mothers. The Break Time for Nursing Mothers Law provision became law when the Affordable Care Act was signed by the president in March 2010. The provision addresses concerns of women who return to work after having a baby.  The release can be found at http://www.dol.gov/opa/media/press/whd/whd20101764.htm

The department will accept public comments in response to a request for information on its preliminary interpretations until February 22, 2011 at http://www.regulations.gov.  Employers and employees are encouraged to visit http://www.dol.gov/whd/nursingmothers for additional information and resources.
